1. Acceptance of Terms

Welcome to VibeCheck! By downloading, installing, or using the VibeCheck mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and VibeCheck ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the App following any changes constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years old to use VibeCheck. If you are under 18, you must have permission from a parent or legal guardian to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you must create an account. You may register using:

• Email and password
• Google Sign-In
• Sign in with Apple

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password
• Not share your account with others
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Description of Service

VibeCheck is an AI-powered social confidence coaching application that provides:

• Conversation Starters: AI-generated conversation openers based on context and selected tone
• Reply Suggestions: AI-powered response suggestions for messages and conversations
• Awkward Situation Advisor: Guidance for navigating uncomfortable social situations
• Screenshot OCR: Text extraction from screenshots for generating responses
• Smart Reminders: Notification system for follow-ups and important dates
• History & Saved Suggestions: Access to past AI-generated content
• Customizable Vibes: Multiple tonality options for personalized responses

5. Subscription Plans and Payments

5.1 Free Trial

New users are eligible for a 3-day free trial of premium features. The trial will automatically convert to a paid subscription unless cancelled before the trial period ends. You will not be charged during the trial period.

5.2 Subscription Plans

VibeCheck offers the following subscription options:

• Monthly Plan: Billed monthly, cancel anytime
• Yearly Plan: Billed annually, best value
• 3-Year Plan: Billed once every three years, maximum savings

5.3 Payment Processing

Payments are processed securely through Razorpay. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan. You agree to:

• Provide accurate and complete payment information
• Update your payment information promptly if it changes
• Pay all fees and applicable taxes
• Accept that prices may change with 30 days' notice

5.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

5.5 Cancellation

You may cancel your subscription at any time through the App settings or your device's subscription management settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

5.6 Refund Policy

All sales are final. We do not offer refunds except as required by law or at our sole discretion. If you believe you were charged in error, please contact us at support@vibecheck.app within 7 days of the charge.

6. AI Service and Content

6.1 AI-Generated Content

VibeCheck uses Google Gemini AI to generate conversation suggestions and advice. You acknowledge and agree that:

• AI-generated content is provided as suggestions only
• You are solely responsible for how you use AI-generated content
• AI suggestions may not always be appropriate or accurate
• We do not guarantee the quality, accuracy, or suitability of AI-generated content
• You should use your own judgment before using any AI-generated suggestions

6.2 Content Limitations

Our AI service is designed to help with social interactions but has limitations:

• AI may occasionally produce inappropriate or offensive content
• Suggestions may not align with your personal values or situation
• AI cannot replace human judgment and social awareness
• Content may be influenced by biases in training data

6.3 No Professional Advice

VibeCheck is not a substitute for professional advice. The App does not provide:

• Mental health counseling or therapy
• Relationship counseling
• Legal advice
• Medical advice

If you need professional assistance, please consult a qualified professional.

7. User Content and Conduct

7.1 Your Content

When you use VibeCheck, you may provide text, screenshots, and other content ("User Content"). You retain ownership of your User Content, but you grant us a license to:

• Process your content through our AI services
• Store your content for providing the service
• Use anonymized, aggregated data to improve our services

7.2 Prohibited Uses

You agree not to use VibeCheck to:

• Harass, abuse, threaten, or intimidate others
• Generate content that is illegal, harmful, or offensive
• Impersonate others or misrepresent your identity
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute spam, malware, or harmful content
• Attempt to circumvent security measures
• Reverse engineer or decompile the App
• Use the App for commercial purposes without authorization
• Scrape or collect data from the App

7.3 Content Monitoring

While we do not actively monitor User Content, we reserve the right to review, remove, or restrict access to content that violates these Terms.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

Key points include:

• We use Firebase for authentication and data storage
• Your content is processed through Google Gemini AI
• Payment information is handled by Razorpay
• We implement industry-standard security measures
• You have rights to access, modify, and delete your data

9. Third-Party Services

VibeCheck integrates with third-party services, including:

• Firebase: Authentication, database, and cloud messaging
• Google Gemini AI: AI text generation
• Razorpay: Payment processing
• Google ML Kit: Text recognition (OCR)

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their practices.

10. Intellectual Property

10.1 Our Rights

VibeCheck and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Use our trademarks without permission
• Create derivative works
• Remove copyright or proprietary notices

10.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

11. Disclaimers and Limitations of Liability

11.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• AI-generated content will be accurate or appropriate
• Defects will be corrected
• The App will meet your expectations

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

• Your use or inability to use the App
• AI-generated content or suggestions
• Unauthorized access to your account
• Third-party services or content
• Any other matter relating to the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

12. Indemnification

You agree to indemnify, defend, and hold harmless VibeCheck, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Your User Content

13. Termination

13.1 By You

You may terminate your account at any time by deleting the App and contacting us to request account deletion.

13.2 By Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law
• We discontinue the service

13.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Your subscription will be cancelled
• Your data may be deleted according to our retention policy
• Provisions that should survive termination will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@vibecheck.app to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes.

14.2 Arbitration

If informal resolution fails, any dispute arising from these Terms or the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial or to participate in a class action.

14.3 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VibeCheck operates, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VibeCheck regarding the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
